Terms and Conditions - Steen & Strøm Online

1. Introduction

Welcome to Steen & Strøm! These terms and conditions (the "Terms") apply to online sales of any products offered for sale on the steenogstromosolo.no website (the "Website"). The website is created and operated by High Street Shopping AS, organisation number 918 753 664, a Norwegian entity having its principal address at Nedre Slottsgate 8, 0157 Oslo, Norway (hereinafter "Steen & Strøm", "we", "us" or "our").

By making a purchase from and using the Website, you agree to be bound by these Terms. We therefore encourage you to read these Terms carefully, as they inform you about who we are, how you will be provided products, what to do if there is a problem and other important information.

2 . Prices

2.1 General

To fulfil your order, the customer is obliged to pay the applicable prices and the currency indicated on the Website. 

Unless otherwise expressly indicated in writing by Steen & Strøm at the time of the definitive validation of the order, the final amount to be paid by the customer include standard taxes, packaging costs and shipment costs, Steen & Strøm reserving its right to choose the means of transportation.

2.2 Taxes – European Union ("EU") and European Economic Area ("EEA")

All prices shown on the Steen & Strøm website, www.steenogstromoslo.no, include VAT for all countries within the EU, in accordance with the applicable legislation. All orders within the EU are shipped with DDP (Delivered Duty Paid) – all taxes and duties are included in the product prices.

3. Ordering process

3.1 Registration of your order

Once you have added your desired products to your online cart, you will be asked to enter the information that is necessary for the correct delivery of your order. You are then invited to select the chosen payment option and to enter the corresponding information.

3.2 Validation of the order

At the end of the ordering process, the customer accepts these Terms by clicking on the appropriate box and definitively confirms the order by clicking on the “Proceed to payment” button. After confirmation of the customer’s order and receipt of payment, we send you an electronic receipt to your e-mail address as a confirmation of your purchase. The contract of sale is then definitively concluded. The conditions of an order may change as long as Steen & Strøm has not confirmed the order.

Unless otherwise provided by applicable mandatory law, Steen & Strøm reserves the right to refuse any order. In such cases, an e-mail will be sent to the customer using the e-mail address communicated by the customer instead of sending an acceptance of the offer. Further, if a given price is incorrect, this may compel Steen & Strøm to cancel the purchase and refund any amount paid in the best way. This can be performed at any time.

4. Shipment

4.1 General

The products purchased on the Website are only available for delivery to Norway. They are delivered at the address communicated at the time of ordering. You are responsible for the accuracy of the information provided when ordering. In case of mistake in the addressee’s contact details (in particular surname, first name, street name and number, postal code, city name, telephone number or e-mail address), Steen & Strøm shall in no event be held liable for the impossibility to deliver the order.

The delivery is made by the carrier(s) indicated on the Website. Applicable prices for your delivery are also set out on the Website. 

The time of delivery is dependent on where you reside. Unless otherwise stated on the Website, delivery occurs within thirty 2-5 business days after Steen & Strøm has received your order and we have issued a receipt of order. 

4.2 Click & Collect

You will find our "Click & Collect" stall on the 4th floor at the Steen & Strøm department store in Oslo, Norway, and it will have the same opening hours as the rest of the department store. Ask our staff to help you locate the Click & Collect stall. We will keep your order(s) for 15 business days.

5. Withdrawal, reimbursement and exchanges

5.1 Right and time of withdrawal

You have a statutory right to withdraw, without having to give any reasons, within fourteen (14) days from the day the product was ordered on the Website and received by you. However, the consumer's right to withdraw does not apply if the ordered product cannot be returned back to Steen & Strøm in the same condition and quantity, and the damage or deterioration is due to negligence or lack of care by the consumer. This means, to be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. Several types of goods are exempt from being returned, such as food, bodysuits, swimwear, hosiery, jewellery and all intimates except bralettes can not be returned. To complete your return, we require a receipt or proof of purchase.

If the order includes several products to be delivered separately, the withdrawal period for all products of this order starts with the rate of receipt of the last product. If the withdrawal period expires on a Saturday, Sunday or a public holiday, the withdrawal period is extended so that it expires on the nearest business day following.

5.2 Notifying us of your withdrawal

In the event that you wish to notify of your intention to withdraw, you must use notify us at: customerservice@steenogstromoslo.no. When notifying us of your intention to withdraw, you must specify to us on how the product(s) will be returned to Steen & Strøm.

Alternatively, you may fill out and send to us the pre-prepared notice of withdrawal (Nw. "angrerettskjema") which is available here. We will as soon as possible send you an email verifying receipt of the form. You will be regarded as having notified us within the statutory period if you notify us of your withdrawal before it lapses. 

5.3 Return and reimbursement

You may choose to return your purchased products to us by postal service to the following address: Kongens gate 23, 0153 Oslo, Norway. 

If Steen & Strøm cannot legally rise any objections, Steen & Strøm will reimburse the customer the total amount paid for the returned products, including shipment costs if included in the total amount paid for the products and paid by the customer but excluding taxes such as applicable VAT, without unjustified delay and at the latest fourteen (14) days starting from the point in time of receipt of the notification to withdraw by Steen & Strøm. To be granted a refund, all returned items must be unworn, undamaged and with all tags attached to their original packaging. 

5.4 In-store drop off

If you prefer to drop off your return physically at the Steen & Strøm department store in Oslo, you may do so by prepare your package with any original documents and take it to "Click & Collect" on the 3th floor of Steen & Strøm, with your return form.

5.5 Late or missing refunds (if applicable)

Please note that it may take some time before your refund is officially posted. If you have waited a reasonable time, contacted your bank/card issuer and you still have not received your refund yet, please do not hesitate  with getting in touch with us at customerservice@steenogstromoslo.no.

5.6 Exchanges

We only replace items if they are defective or damaged. If you need to exchange a product for the same item, send us an email at customerservice@steenogstromoslo.no. Then, you may send your damaged/defective good to: Steen & Strøm, Kongens gate 23, 0153 Oslo, Norway.

6. Products

6.1 Product availability

The product and price offerings are in force as long as they appear on the Website, within the limits of available stocks. 

Mistakes or changes may exceptionally occur. In the event of unavailability of any product after ordering, the customer is informed per e-mail (or mail if he/she has not provided any e-mail address) of the unavailability of the product(s) and of the delivery of a partial order or the cancellation of the order. 

In case of complete or partial cancellation of the order due to unavailability, the amounts corresponding to the unavailable products will not be debited from the customer’s bank account. If the amounts have already been debited, the customer will be reimbursed the amounts paid for the unavailable products within thirty (30) days.

6.2 Changes to prices, product information etc.

Steen & Strøm has the right to adjust prices, involve additional costs, and change product information such as product pictures and offers without notice. The product images and information texts available reflect the product as much as possible. We reserve the right for any errors that may appear on the page and cannot guarantee that all pictures accurately reflect the true appearance of the product. The pictures may differ depending on the colour settings on your computer. All pictures should be seen as illustrations only and do not guarantee correct appearance and characteristics.

7. Complaints

It is important that you, as a customer, carefully check your goods/products when you receive your shipment to verify that the products are correct and not damaged. If your product is damaged in transport, whether the damage is visible or hidden, you must report this as soon as possible to the carrier. If you receive your item and see that it is damaged or does not match the one you ordered, you shall also contact us within 14 days of receiving the product.

Any complaints shall be made to our customer service through e-mail (customerservice@steenogstromoslo.no). Please supply the order number and the reason for the complaint and we will get back to you shortly with instructions on how to return the item. Defective products returned to Steen & Strøm should be treated as if they were faultless. It is in all types of returns extremely important that the product is packaged in such a way that it cannot be damaged during transit. In the case that a returned product has no errors or faults. Steen & Strøm has the right to replace defective goods with goods of the same model. If the item has been discontinued, the customer will receive a full refund.

8. Intellectual property rights and user content

8.1 Intellectual property 

All intellectual property rights, such as trademarks and copyright, on the Website and in the material published on it are owned by Steen & Strøm or its subsidiaries or licensors. Any use of the site or its content, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of Steen & Strøm.

8.2 User content

The Website may include user-generated content from, for example, social media applications. Steen & Strøm does not claim any ownership in rights to such content (images, photos, videos, etc.) and takes no legal responsibility for it. In case you suspect a violation of copyright or any other right or otherwise are offended by such content, don't hesitate to get in touch with our customer service.

8.3 Retention of title

All products remain on Steen & Strøm property until full payment is made.

9. Competitions and newsletters

9.1 Competitions

Occasionally, we may promote competitions on our Website. Specific arrangements and rules will apply to these competitions. Please ensure that you read carefully the terms and conditions applicable to any competition in which you participate as you will be deemed to have accepted the terms and conditions of this competition and to be bound by them if you participate. During these competitions, we will need to collect certain information allowing us to apply the rules. This information will be stored securely in accordance with European legislation.

9.2 Newsletters

You can decide to subscribe to our newsletter to be alerted of news, offers and events. You can unsubscribe at any time from our newsletters by clicking on the link directly in the newsletter.

10. Third party websites

Our Website may contain links to other websites operated by companies and persons unrelated to us (“Third Party Website”). These links are provided for informational purposes only.

The inclusion in our Website of links to a Third Party Website does not mean that we approve, endorse or accept any liability for this Third Party Website, its content or use, or the use of products and/or services offered through the aforementioned Third Party Website. We have not researched, tracked or verified third party websites in terms of accuracy, completeness or compliance with applicable law. We cannot be held liable for damages or losses caused by your use of, or confidence in, the Third Party Websites and you use the Third Party Websites at your own risk. All the terms and policies of the Third Party Websites that you visit will be applied to the aforementioned websites and should be consulted.

We have agreements with carefully selected companies that may sell you products or services on Third Party Websites whose links appear on our Website. These sites display our logo or mention an association with our company, such as The Village loyalty card. When you follow the link of these Third Party Websites, they may still be framed by our Website or display our logo, and be part of our Website. However, be aware that these products and services are sold by another company. Although we select these companies carefully, we are not responsible for the products and services they offer and sell, and you are responsible for reviewing the terms and conditions of such Third Party Websites and any products and/or services that they offer.

Steen & Strøm complies with applicable data protection laws in force in Norway. Please see our privacy policy for information regarding our processing of your personal data. 

12. Termination

Steen & Strøm reserves the right to terminate your account and/or your use of the Steen & Strøm website, www.steenogstromoslo.no, at its sole discretion. For example, if Steen & Strøm suspects that you have breached these terms of use. Such termination can be made without prior notice.

13. Amendments to these terms

Steen & Strøm may revise these terms of use from time to time. Every time you order a product from us, the version of the Terms in force at that time will apply to the contract between you and Steen & Strøm. You should, therefore, periodically visit this page to review the then-current terms to which you are bound.

14. Limitation of liability

To the maximum extent permitted by law, in no event will Steen & Strøm be liable for (1) any indirect, special, incidental, punitive, exemplary, or consequential damages; or (2) any loss of use, data, business, or profits (whether direct or indirect), in all cases arising out of the use or inability to use the Steen & Strøm service, Third Party Applications, or Third Party Application content, regardless of legal theory, without regard to whether Steen & Strøm has been made aware of the possibility of those damages, and even if a remedy fails of its essential purpose. Steen & Strøm’s aggregate liability for all claims arising under or in connection with this Agreement shall be limited to the amounts paid by you to Steen & Strøm under this Agreement during the twelve months immediately preceding the last event giving rise to liability.

Nothing in the Agreement removes or limits Steen & Strøm’s liability for fraud, fraudulent misrepresentation, death or personal injury caused by its negligence, and, if required by applicable law, gross negligence.

15. Force majeure

Steen & Strøm shall be exempt from liability for damages and other penalties on the performance of the contract prevented, hindered, or delayed by circumstances beyond our control and which is to be regarded as force majeure event under Norwegian law.

16. Governing law and legal venue

16.1 Governing law

These Terms, as well as any transaction herein described and/or in relation with any sale of its products by Steen & Strøm to the customer are governed, construed and enforced in accordance with the laws of Norway. 

16.2 Legal venue

In case of dispute with professionals and/or tradesmen, the Courts of Norway will have exclusive jurisdiction.
